Information Collection, Posted and Use
Communications from the Site
Outdoor Eyes is the sole owner of the information collected on Outdoor Eyes. Outdoor Eyes collects information from our users at several different points on our web site (The Forum, The Gallery and registration).
In order to use the Forum or The Gallery, a user must first complete the registration form. During registration a user is required to give contact information such as name and email address. We use this information to contact the user about services on our site for which he has expressed interest.
We request information from the user on our order form. A user must provide contact information (such as name, email, and mailing address) and financial information (such as credit card number, expiration date). This information is only used for billing purposes and to fill customer’s orders. If we have trouble processing an order, the information is used to contact the user.
There are various links within the pages of the web site, providing you methods to contact us easily. We read the mail you send us and reply with the information requested in a timely fashion. We do not share your personal information with others. Our site's information forms request your name, email address and telephone number as well as additional information to help us determine your needs.
We use this information to send you updates about our company or to contact you if requested or necessary. You may change your personal profile or opt-out of receiving future mailings at any time.
We store information that we collect to create a profile for the forum and for The Gallery. We do not share your profile with other third parties.
A cookie is a piece of data stored on the users’ computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. We use session ID cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the users’ hard drive for an extended period of time.
Like most standard Web site servers we use log files. This includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track users’ movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.
Posted Photograph & Text Verification
You agree that all materials which are transmitted by you for the use in The Forum, in The Gallery, in the Newsletter, in Outdoor Eyes articles, are your sole and exclusive responsibility. You agree that you will not use the Service to upload, post or otherwise transmit any content that is: unlawful, harmful, threatening, profane, abusive, harassing, tortuous, defamatory, vulgar, obscene, or pornographic, or which may give rise to civil or criminal liability under applicable law; libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; harmful to minors in any way; or violative of any copyright or other proprietary rights of another. Outdoor Eyes does not intend to pre-screen content uploaded or submitted, and is not responsible for such content, Outdoor Eyes reserves the right to edit or remove content which violates any of the foregoing provisions. If photographs or text are contributed for an article, the photographs and text will be identified with "Copyright © 200_ [your name]. All rights reserved.
License Grant To Outdoor Eyes
Outdoor Eyes does not claim any ownership in the photos, sound recordings, videos or other media created or uploaded by you or any other user ("Media"). Consequently, Outdoor Eyes will not license, resell, or otherwise distribute Media to third parties. Unless otherwise indicated, by uploading or submitting Media for articles within the Outdoor Eyes, you grant Outdoor Eyes a nonexclusive, royalty-free license to publish, distribute and display the Media, without limitation, anywhere within Outdoor Eyes and within email communications promoting Outdoor Eyes. This license shall be in effect during all times that relevant Media is contributed by you for Outdoor Eyes. This license shall NOT apply to Media placed in The Gallery or on The Forum.
Furthermore, you represent and warrant that you own or otherwise control all of the rights to the Media that you post or submit; that you have received all proper permissions and/or releases relative to all media that you post; that use of the Media you store in any Gallery does not violate these Terms and will not cause injury to any person or entity; and that you will indemnify Outdoor Eyes for all claims resulting from Media you supply. Outdoor Eyes has the right but not the obligation to monitor and edit or remove any activity or Media. You understand and agree that Outdoor Eyes takes no responsibility and assumes no liability for any Media posted or submitted by you or any third party.
You agree to defend, indemnify, and hold harmless Outdoor Eyes and its subsidiary and other affiliated companies, and their employees, officers, directors, contractors, agents, licensors and suppliers, from all liabilities, losses, damages, claims, costs and expenses, including reasonable attorney's fees, that arise from (i) use or misuse of Outdoor Eyes or any person to whom you have granted access to Outdoor Eyes, (ii) your violation of any of these Terms, or (iii) any other activity related to your account (including negligent or wrongful conduct). Outdoor Eyes reserves the right, at it own expense, to assume the exclusive defense and control of any matter otherwise subject to defense by you, in which event you will cooperate with Outdoor Eyes and its counsel in the conduct of such defense.
Newsletter & Additions
Established members of the forum will occasionally receive information on new additions to the forum or the Outdoor Eyes Newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications.
On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.
We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account we reply via email or phone, in accordance with the users wishes.
Sharing Legal Disclaimer
Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.
Aggregate Information (non-personally identifiable)
We DO NOT Share Personal Information with Third Parties.
Third Party Intermediaries
We use an outside a credit card processing company (PayPal) to bill for The Gallery. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.
We offer an opt-out mechanism on the member's forum page to remove the member from the forum and receiving of the newsletter.
This Web site contains links to other sites. Please be aware that we, Outdoor Eyes, is not
responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to Outdoor Eyes.
Outdoor Eyes takes every precaution to protect our users’ information. When users submit sensitive
information via the Web site, their information is protected both online and off-line. When our registration/order form asks users to enter sensitive information (such as credit card number and/or social security number), that information is encrypted and is protected with the best encryption software. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when users are just ‘surfing’. All of our users’ information, not just the sensitive information mentioned above, is restricted in our offices.
Supplementation of Information
In order for Outdoor Eyes to properly fulfill its obligation to users it is necessary for us to supplement the information we receive with information from 3rd party sources.
We use PayPal to verify a users’ identity and credit card confirmation for The Gallery.
Correcting/Updating/Deleting/Deactivating Personal Information
If a users’ personally identifiable information changes (such as zip code, phone, email or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users’ personally identifiable information. This can usually be done at the member's profile page.
